1) Who we are

“Esports Jersey Design” (“we”, “us”, “our”) provides custom digital design services. Contact: hello@esportsjerseydesign.com. These Terms govern your purchase and use of our services at our website (the “Site”).

2) Eligibility & Account

You must be able to form a contract in your jurisdiction. You’re responsible for the accuracy of information you provide (including your email and Discord handle).

3) Ordering Process

• You submit a brief via our form and pay via PayPal.

• We confirm receipt by email/Discord.

• First draft delivery: typically 3–5 business days after we have your paid order and a complete brief and required assets.

• Rush delivery may be available for an extra fee (quoted at checkout or on request).

4) Scope & Revisions

• Your purchase covers the deliverables described on the product page at checkout.

• Revisions included: 3 rounds for the purchased concept(s).

• Additional revisions, alternate concepts, or changes in scope are billed at our then-current rates (quoted before work continues).

• If you request changes that require new direction or brand strategy, we may treat them as out-of-scope and provide a separate quote.

5) Client Materials & IP Assurances

You warrant that any content or brand assets you supply (e.g., team logos, sponsor marks, fonts, images) do not infringe third-party rights and that you have permission to use them. You’ll indemnify us for claims arising from assets you provided or directions you required.

6) Payments & Taxes

• Payments are processed by PayPal. We don’t store card details.

• Prices may exclude applicable taxes; you’re responsible for any taxes, duties, or fees required by law.

• Work begins after payment clears and a usable brief is received.

7) Cancellations & Refunds

• No refunds after design work has started.

• If you cancel before work begins, we may issue a refund less any non-recoverable processing/admin costs.

• If we cannot complete the project due to unforeseen reasons not caused by you, we’ll offer a pro-rata refund for the uncompleted portion.

8) Delivery & Acceptance

• Deliverables are digital files (e.g., mockups, print-ready artwork) supplied via download link or email/Discord.

• A deliverable is deemed accepted when (a) you approve it in writing, or (b) 7 calendar days pass after delivery without written objections. Objections must be specific and tied to the agreed scope.

9) Intellectual Property

• Ownership: Upon full payment, we assign to you all right, title, and interest in the final design files we specifically created for your order (excluding our pre-existing tools, templates, know-how, and licensed materials that cannot be assigned).

• Portfolio License (license-back): You grant us a non-exclusive, worldwide, royalty-free license to display the work (images/mockups of the final design) in our portfolio, social channels, and marketing to showcase our services, provided we don’t disclose your confidential information.

• Third-party materials: Any third-party licensed content used in your project remains governed by its own license terms.

10) Usage & Production

You are responsible for the correct and lawful use of the designs (including compliance with league rules, sponsor guidelines, and printer/manufacturer specifications). We’re not liable for production errors beyond our files’ delivered specifications.

11) Confidentiality

We’ll keep non-public project information confidential and only use it to provide the services, except where disclosure is required by law.

12) Warranties & Disclaimers

Services are provided “as is”. To the maximum extent permitted by law, we disclaim all warranties (express or implied), including merchantability, fitness for a particular purpose, and non-infringement (except as expressly stated regarding our own original work).

13) Limitation of Liability

To the fullest extent permitted by law, our total liability for any claim arising out of or relating to these Terms or the services shall not exceed the amount you paid for the specific project giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits/revenues.

14) Indemnity

You agree to defend, indemnify, and hold us harmless from claims, losses, and costs (including reasonable attorneys’ fees) arising from (a) your breach of these Terms, (b) your provided materials or directions, or (c) your use of the deliverables contrary to law or third-party rights.

15) Force Majeure

Neither party is liable for delays or failures caused by events beyond reasonable control (e.g., outages, strikes, acts of God). Payment obligations are excluded from force majeure relief.

16) Governing Law & Venue

These Terms are governed by the laws of the State of New York, without regard to its conflict of law rules. The exclusive venue for disputes is the state or federal courts located in New York, New York, and you consent to their jurisdiction.

17) Updates to these Terms

We may update these Terms occasionally. Material changes will be posted on the Site with a revised “Last updated” date. Continued use or new orders after changes means you accept the updated Terms.
